Important: GivWord is not a law firm and does not give legal advice. A GivWord note is a written record of what you say was agreed. It is not a contract and does not make any agreement binding.
These Terms of Service (“Terms”) are an agreement between you and GivWord, Inc. (“GivWord,” “we,” “us”). They govern your use of givword.com, our waitlist, and the GivWord mobile app (together, the “Service”). By using the Service, you agree to these Terms and to our Privacy Policy. If you don’t agree, please don’t use the Service.
You must be at least 18 years old and able to form a binding agreement to use GivWord. If you use GivWord on behalf of a business, you confirm you are authorized to accept these Terms for it.
GivWord helps you write down, after a conversation, what you understand was agreed, organize it with the help of AI, and share the same note with the other person.
Keep your sign-in details secure and tell us promptly if you think someone else has accessed your account. You are responsible for activity under your account. Provide accurate information and keep it up to date.
You own the content you create in GivWord, including your notes, drafts and attachments (“Your Content”). You give us a limited, worldwide, royalty-free license to host, store, process, transmit and display Your Content only as needed to provide the Service to you — for example, to transcribe it, organize it and send it to the people you choose.
You are responsible for Your Content, including its accuracy. Notes reflect your own account of a conversation. Review every note carefully before you confirm it.
GivWord uses AI to transcribe and organize what you say or type. AI output can be incomplete or wrong. Extracted details are labeled with a confidence level, but labels are not guarantees. You are responsible for reviewing and correcting a note before you send it.
When you confirm a note, GivWord sends it, on your instruction, to the people you name. By sending a note, you confirm that:
Recipients can reply STOP to text messages, or contact us, to stop receiving messages from GivWord. We may limit or block sending to protect recipients.
GivWord is designed for dictation after a conversation, not for recording it. If you choose to record any conversation by other means, you alone are responsible for complying with recording and eavesdropping laws, which in some places require everyone’s consent.

We show delivery events reported by our email and text providers. Delivery to a mail server or carrier does not mean the recipient opened, read or understood a note, and we don’t claim otherwise.
We may in the future help you find independent attorneys. Attorneys are not employed by, supervised by or agents of GivWord, and we don’t recommend or guarantee any attorney. Any relationship you form with an attorney is between you and that attorney.
Joining the waitlist doesn’t guarantee access by any date. Early-access or beta features may change, have errors or be withdrawn.
The Service, including our software, design, name, logo and other brand features, belongs to GivWord and its licensors. These Terms don’t give you any right to use them except to use the Service as intended.
If you send us feedback or ideas, we may use them without any obligation to you.
The Service relies on, and may link to, services run by others, such as app stores, sign-in providers and payment processors. Their terms and privacy policies apply to your use of them, and we aren’t responsible for them.
You can stop using GivWord and delete your account at any time. We may suspend or end your access if you break these Terms, create risk for others or for GivWord, or if we are required to by law. Where reasonable, we will tell you first. Sections that by their nature should survive termination will survive.
To the fullest extent permitted by law, the Service is provided “as is” and “as available,” without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, accuracy and non-infringement. We don’t warrant that the Service will be uninterrupted or error-free, or that any note or AI output will be accurate or complete.
To the fullest extent permitted by law, GivWord and its officers, employees and agents will not be liable for any indirect, incidental, special, consequential or punitive damages, or for lost profits, data or goodwill, arising from your use of the Service. Our total liability for any claim relating to the Service will not exceed the greater of the amount you paid us in the 12 months before the claim arose, or $100.
Some jurisdictions don’t allow certain of these limits, so they may not all apply to you. Nothing in these Terms limits liability that cannot be limited by law.
To the extent permitted by law, you agree to defend and indemnify GivWord against claims, losses and costs (including reasonable attorneys’ fees) arising from Your Content, notes you send, or your breach of these Terms or of the law.
These Terms are governed by the laws of the State of California, without regard to conflict-of-law rules. Any dispute will be resolved in the state or federal courts located in Sacramento County, California, and you and GivWord consent to their jurisdiction. If you are a consumer, you may also have rights under the laws of where you live that these Terms can’t override.
We may update these Terms. If a change is material, we will tell you by email or in the app before it takes effect. If you keep using the Service after the change takes effect, the updated Terms apply.
These Terms and our Privacy Policy are the entire agreement between you and GivWord about the Service. If any part is found unenforceable, the rest stays in effect. Our failure to enforce a provision isn’t a waiver. You may not transfer these Terms without our consent; we may transfer them as part of a merger, acquisition or sale of assets.
